Land Trusts and "As-Is" in Wisconsin
Join us for special guest Attorney Marty Greenberg as he discusses some key items regarding real estate transactions. Among the many things he will discuss, here are the key points he will touch on concerning the As-Is clause...
- The most common lawsuit involving real estate is a suit for fraud, misrepresentation, and breach of contract for representations as it relates to the mechanical and physical aspects of the property prior to sale.
- The use of As-Is clauses is misunderstood by real estate professionals, a seller will want to make certain that a closing is a closing and their money is protected from further attack from lawsuits.
- Sample As-Is clauses used by the real estate community indicate a misunderstanding of the protection provided.
- Being in a lawsuit involving claims of fraud, misrepresentation, and breach of contract are expensive and time consuming.
Marty's discussion will review the current legal status of the use of As-Is clauses in real estate contracts in Wisconsin and what is fully protective of a seller when selling to make certain a closing is really a closing.
Land Trusts are a curious thing to many, and Marty will also be covering those. Here's a few of the bullets that he will cover on that topic:
- Is an Illinois Land Trust legal in Wisconsin?
- What is the difference between an active and a passive trust?
- How does a land trust differ from other means of holding title to real estate?
- What are the advantages of using a land trust?
- Does the title insurance industry recognize land trusts in Wisconsin and insure titles for property where the title of the real estate is held in a land trust?
There will be plenty of time for Q & A, and we're expecting a lot of that.
